Contract Crisis: Have A Winning Chance?

As we near the end of Quarter 1, 2025, I'm reminded of the contract woes that many have faced.
I've had clients who have endured loss of income from people walking away from their contract obligations because there were not clear guardrails to guard against the opposing party's breach. I've had known business moguls discuss their dissatisfaction at how other entrepreneurs casually disobey the terms of their agreements.
We can't stop others from breaking their promises and business obligations, but we can certainly get paid when they do.

This month, I'll close this quarter having helped a client get a win against another company who breached their agreement by failing to pay per the terms of the agreement. This win ended in getting a Motion for Default, sanctions, and dismissal of the other party's counterclaim against my client.
There's still more work to do to enforce our $40,000.00 plus judgment, but it's a learning example for all the entrepreneurs who are playing in the top 1% of their markets and for those who wish to.
Contracts are not always ironclad but can be instrumental in helping you fight and win. Here's where my client got this current win:
🚩 Step 1: Attorney Fee provision. My client made sure that if there was a breach, and she had to file a case, she would be entitled to her attorney fees.
🚩 Step 2: Clarity on default language. My client further expressed what would happen if a party defaulted on the agreement and what the financial cost would be.
Too many of you are hoping that others will play nice and fair. I'm here to tell you that they won't.
